General Sales Conditions
SCOPE:
The general conditions of sale apply to all commercial transactions.
Anicolor reserves the right to amend the general conditions of sale without prior notice, safeguarding acquired rights in respect of ongoing transactions.
ORDERS AND PROPOSALS:
Anicolor reserves the right to only consider, accept, and process orders submitted in written form on behalf of the customer (purchase order, email, requisition, proposal, or quotation duly signed and stamped by the customer).
Orders will be processed upon receipt and imply full acceptance of the general conditions of sale. They may not be cancelled, in whole or in part, without Anicolor’s prior consent. Customers waive the right to enforce different clauses contained in their own documents.
Orders are registered without obligation of full delivery.
Failure or delay in payments entitles Anicolor to suspend current orders or to request payment guarantees.
Specifiers and professional installers are solely responsible for choosing the products in line with the intended use, applicable regulations, and final customer specifications.
PRICES:
Unless otherwise stated, the price of the products shall be based on the price list in force on the order date or on a quotation, and shall be subject to statutory taxes.
Price lists are provided for guidance only and are subject to change without prior notice.
Anicolor reserves the right to update prices, when necessary, for all orders in progress that have not yet been delivered.
PRODUCTS:
Anicolor may, without prior notice, introduce any changes deemed appropriate to its profiles, accessories, and gaskets in order to improve their technical and aesthetic quality.
DELIVERY TIMES:
Delivery times are provided for guidance only. We shall not be held liable for any delays resulting from external causes, manufacturing risks, or transport issues.
Delivery times are calculated from the date the order is registered with our services.
A delay in delivery shall under no circumstances give rise to claims, payment compensation, indemnity of any kind, refusal of the products, or cancellation of the order.
PAYMENTS:
Payment terms are strictly 30 days from the invoice date, subject to credit approval and prior agreement. Depending on individual credit conditions and/or insurance requirements, the company reserves the right to request payment before dispatch or upon receipt of the order.
The company further reserves the right to charge late payment interest at the maximum legal rate in force for each day of delay.
In the event of non-compliance, the company may demand immediate payment in full, regardless of previously agreed terms.
No deductions from payments will be accepted. Only credit notes issued by the company have legal validity.
For payments made 30 days after the agreed due date, Anicolor reserves the right not to apply any financial discount, where applicable.
TRANSPORT:
Transport arrangements shall be agreed at the time of negotiating commercial conditions.
CLAIMS:
The customer must inspect and verify the products at the place and date of receipt, and before any use.
Claims must be submitted to the sales department, accompanied by documents and/or photographs supporting the reason for the claim.
Applicable claim deadlines are as follows:
- Reference discrepancies: 10 days
- Finishing defects: 30 days
- Extrusion defects: 180 days
RETURNS:
Products may only be returned for issuance of a credit note with Anicolor’s prior written approval and must be in good condition (as determined by our quality department). Products must also be returned properly packaged and accompanied by the relevant return documents.
LIABILITY:
Anicolor’s liability is strictly limited to replacing goods that are proven to be manifestly defective.
All assembly and disassembly costs are excluded.
Anicolor shall not be held responsible for any technical misuse of the materials. Assembly diagrams and catalogue suggestions are for guidance only, and installation is carried out under the sole responsibility of the installer/customer.
Anicolor shall likewise bear no responsibility in the event of improper technical application of its products.
WARRANTIES:
The warranty on our products complies with applicable legal provisions.
PERSONAL DATA PROTECTION:
In accordance with the General Data Protection Regulation (GDPR), Anicolor makes every effort to limit the collection of personal data to what is strictly necessary, to preserve it over time, and to ensure its protection.
Anicolor uses this data exclusively for its own purposes, namely for product information and marketing.
Under no circumstances will the data be transferred to third parties.
The right to access, rectify, delete, and object to processing, as well as the right to restrict and port personal data, may be exercised by contacting Anicolor’s Data Protection Officer (DPO) by email: anicolor@anicolor.pt, or by registered mail with a copy of an identification document, to the following address:

JURISDICTION:
Applicable law: Portuguese.
Jurisdiction: the courts of our registered office.
The present general conditions of sale are valid from January 2023.
